[1]The claims for race discrimination are struck out.REASONS
[1]The claimant was ordered to pay a deposit of £1,000 following a preliminary hearing held on 20 July 2022. The Order was sent to the claimant on 28 July 2022. The claimant has failed to pay this deposit. The complaint of race discrimination is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]Rule 39(4) states that where a deposit order has not been paid, the claim will be struck out. A tribunal has no discretion about the matter: the strike out occurs automatically upon the failure to pay. 2. The hearing fixed for 8-10 February 2023 will not take place.
