JUDGMENT

[1](1) The Claimant’s claim of pregnancy and maternity discrimination was presented outside the primary limitation period but it is just and equitable to extend time. Accordingly, that claim is allowed to proceed.(2) The Claimant’s claim of an unlawful deduction of wages was presented outside the primary limitation period and it was reasonably practicable for it to be presented within that period. The Tribunal has no jurisdiction to consider this claim. Accordingly the issues at paragraphs 42 – 43 of the Case Management Order dated 11 May 2022 will not be considered by the Tribunal at the full merits hearing. JUDGMENT[2](1) The Claimant’s application to amend her claim of Unfair Constructive Dismissal is allowed.(2) Accordingly, the Claimant’s claim includes an allegation concerning a meeting on 25 January 2021, as set out in paragraph 29(d) of the Case Summary from the Preliminary Hearing on 11 May 2022.
