JUDGMENT

[1]Under the provisions of Rule 69, the Judgment on the Respondent’s Strike Out Application sent to the parties on 25 August 2022, is corrected on 5 September 2022 as set out in bold type in the header and beneath the signature (in relation to the date). The Respondent’s application to strike out the Claimant’s claim on the basis that he had failed to comply with the requirement under s. 18A(1) Employment Tribunals Act 1996 to provide prescribed information to ACAS before instituting the proceedings is refused. JUDGMENT[2]The claim of suffering a detriment and/or dismissal resulting from a failure to allow an Employee to be accompanied or to accompany a fellow employee at a disciplinary/ grievance hearing is struck out.

REASONS

[1]The claimant was ordered to pay a deposit of £50 following a preliminary hearing held on 23 June 2021. The Order was sent to the claimant on 25 August 2022. The claimant has failed to pay this deposit and has stated that he has no intention of paying it. The complaint is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The hearing fixed for 16 September 2022 will not take place.
