The claims of unfair dismissal and victimisation are struck out.REASONS
[1]The claimant was ordered to pay a deposit of £400.00 following a preliminary hearing held on 18 March 2019. The Order was sent to the claimant on 28 May 2019 .The claimant has failed to pay this deposit. The complaints of unfair dismissal and victimsation are therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]Employment Judge Moore has considered whether it is in the interests of justice to vary the order under Rule 29 of the Employment Tribunal Rules of Procedure and has decided it is not.[3]The claimant has acknowledged she received the order on or around 29/30 May 2019. Full instructions on how to pay the deposit are sent with the order. Even if the claimant needed longer as of 8 July 2019 the deposit still has not been paid.[4]The claimant had the opportunity to make representations about her ability to pay a deposit at the hearing. Although the claimant has referred to a limited income in her email dated 21 June 2019 she has not provided any further evidence of her inability to pay.[5]The hearing fixed for 6, 7 and 8 April 2020 will not take place.
