JUDGMENT
[1]The hearing continues in the absence of the claimant under Rule 47 Employment Tribunal Rules of Procedure 2024. Before making that determination, the Judge was satisfied that:- 1.1. The claimant had received notice of this final hearing from the Tribunal. 1.2. The claimant had been told of the hearing numerous times by the respondent’s representatives in correspondence. 1.3. The claimant’s claim is for unfair dismissal only and he had acknowledged in correspondence that he was re-engaged in his employment following the appeal of his dismissal. 1.4. The claimant had been copied to all of the respondent’s correspondence applying for the claim to be struck out since January 2025, and had not taken the opportunity to object. 1.5. The claimant had emailed to say that he was in the process of travelling to Lagos and was unable to join the hearing at its commencement. 1 of 2 Case Number: 2301692/2024[2]The claimant’s claim for unfair dismissal is struck out for having no reasonable prospect of success, it having vanished upon his reinstatement by the respondent when he appealed his dismissal (Patel v Folkestone Nursing Home Limited [2018] EWCA Civ 1689 applied).[3]This claim was for unfair dismissal only and this judgment brings the entire case to an end.
