Mr L Gibb v Gallery Nightclub Ltd (in liquidation): 2301539/2018

EMPLOYMENT TRIBUNALS
Case No 2301539/2018
Mr L GibbClaimantGallery Nightclub Ltd (in liquidation)Respondent
Employment Judge CheethamDate 24 August 2020

JUDGMENT

[1]The claims for unpaid salary, holiday pay, notice pay and expenses are dismissed.

REASONS

[1]This has been a remote hearing on the papers, which the parties have not objected to. The form of remote hearing was: V - video. A face to face hearing was not held because it was not practicable and the issue of the future determination of the claim could be resolved from the papers. The documents that I received were those contained in the Tribunal case file.[2]Neither party participated in this hearing. An email from the liquidator for the Respondent emailed the tribunal on 21 August 2020 with the information that the company was in liquidation, but did not say whether there would be attendance at this hearing. Case Number: 2301539/18/V[3]The Claimant had not joined by 10.00, so the tribunal clerk attempted to call him, without success. We waited until 10.30, but there was still no attendance and there was no communication from the Claimant explaining his absence.[4]In those circumstances and bearing in mind that this was an adjourned hearing, I could see no reason to re-list the hearing, but dismissed the claims for unpaid salary, holiday pay, notice pay and expenses, all of which were disputed.
