Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the London South Employment Tribunals on 05 May 2022. The respondent indicated they did not intend to defend the claim therefore the claim succeeds. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £586.35 gross.[3]The respondent has failed to pay the claimant’s holiday entitlement and must pay the claimant £280.[4]The respondent must pay the claimant £866.35 in total.[5]The claimants claim for £40 for the cost of 5 black t-shirts, purchased due to a lack of uniform, is not one which can determined under the Employment Rights Act 1996 and therefore fails.[6]The hearing listed on 30 November 2022 is cancelled.
