Mr S Naylor v Jacksons Hub Ltd: 2301361/2022

EMPLOYMENT TRIBUNALS
Case No 2301361/2022
Mr S NaylorClaimantJacksons Hub LtdRespondent
Date 17 January 2023

JUDGMENT

[1]The Claimant did not attend. I paused the hearing until 10:15 to allow the Clerk to make enquiries of the Claimant by telephone. The Claimant did not respond to two telephone calls and voicemail message.[2]It appears that the Claimant did not comply with - or respond to - the orders issued by the Tribunal on 16 September 2022 which attached the notice of hearing for today (a corrected date (from 16/1/22 to 16/1/23) being sent by email on the same day). He has also not, apparently, complied with the directions given by the Tribunal on 22 November 2022 to confirm readiness for the hearing today.[3]As the Claimant has not attended the hearing today and as we have neither heard from, nor been able to contact, him I dismiss the claim entirely under Rule 47 The Employment Tribunals Rules of Procedure 2013 (as amended). I am entirely satisfied that the Claimant has had ample notice and opportunity to engage with the Tribunal and to attend the hearing. I am also satisfied that the Tribunal has made all reasonable enquiries today and maintained suitable contact with the parties since the Claim was first presented. Judge M Aspinall on Tuesday, 17th January 2023 Note Reasons for this judgment having been given orally at the hearing, written reasons will not be provided unless they are requested - by either party - within 14 days of this notice.
