JUDGMENT
[1]The complaint of unfair dismissal is well-founded. The respondent is ordered to pay the claimant compensation for his unfair dismissal for asserting a statutory right, being a compensatory award of £10,642.63 comprising of: £8,014.94 for losses; a 25% uplift of £2003.73 for a failure to apply the ACAS code of practice; and an award of £623.96 made pursuant to section 38 of the Employment Act 2002.[2]By consent, the respondent is ordered to pay the claimant the sum of £92.93 for unpaid accrued holiday entitlement due at the termination of his employment.
