Mr O Ezeh v Sainsbury's Supermarkets Ltd: 2301192/2022

EMPLOYMENT TRIBUNALS
Case No 2301192/2022
Mr O EZEHClaimantSainsbury's Supermarkets LtdRespondent
Employment Judge RamsdenDate 20 November 2023

JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 2 August 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the claims were brought beyond the primary time limits set out in law for brining such claims; and that as a result, the Tribunal lacks proper jurisdiction to determine any of his claims that he has failed to comply with Orders of Employment Judge Ramsden which were made and explained to him on 26 June 2023; and that because he has failed to comply with those Orders, he has delayed the Respondent in their ability to undertake what was required of them by the Case Management Order and that this amounts to his conducting the proceedings in an unreasonable manner.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
