Mr O Olojo v Rendall and Rittner Ltd: 2301174/2020
JUDGMENT
The claim is struck out.REASONS
[1]A preliminary hearing was held in this matter on 25 October 2021. The claimant was notified of that hearing but failed to attend without prior explanation. A copy of the orders made at that hearing were sent to the claimant on 27 October 2021. Those orders required the claimant to write to the Tribunal and the respondent by 22 November 2021 with specified information. The claimant did not do so.[2]Having had this brought to the Tribunal’s attention by the respondent, the Tribunal wrote to the claimant on 6 January 2022 warning him that consideration was being given to striking out his claim because he had not complied with the order and the claim had not been actively pursued. He was invited to send any reasons in writing or request a hearing if he objected to that proposal, by within 28 days. There has been no contact from the claimant to either the Tribunal or the respondent following that notification.[3]It is apparent that the claimant is not actively pursuing his claim and accordingly it is struck out.[4]The hearing on 23 May 2022 is vacated.
