JUDGMENT
[1]The claim for unfair dismissal is dismissed upon withdrawal.[2]The respondent wrongfully dismissed the claimant.[3]The respondent shall pay the claimant one week’s pay in lieu of notice being £234.23, awarded net of statutory deductions.[4]The respondent did not make unauthorised deductions from the claimant’s wages contrary to section 13 Employment Rights Act 1996.[5]By consent, the respondent shall pay the claimant in respect of accrued but untaken holiday £282, awarded gross of statutory deductions. Case Number: 2301174/2018[6]It is just and equitable to increase the award to the claimant under section 38 Employment Act 2002 by the higher amount of four weeks pay, being £1,008.[7]The claimant did not breach her contract of employment and respondent’s contract claim is dismissed.[8]The total the respondent shall pay to the claimant under this judgment is accordingly £1,524.23.
