JUDGMENT

(1) The Tribunal proceeded in the claimant’s absence under rule 47 as it was considered proportionate to do so. The Tribunal delayed the start time to 10.00am. The clerk confirmed the claimant had been correctly sent the CVP information to join the hearing. This is a 2018 claim and the hearing had been postponed previously. It was considered proportionate to proceed having regard to the overriding interest.(2) The correct respondent is EBC Global Trading ltd. The respondent is substituted under rule 34.(3) Having heard evidence from Mr Fetwi, considered the relevant documents in a bundle of 18 pages and having heard Mr Fetwi’s submissions and having regard to the respondent’s counterclaim: a) The claimant succeeds in a claim for outstanding accrued annual leave in the sum of £67 b) The respondent’s counter claim succeeds in the sum of £375[4]Therefore, the respondent is awarded judgment in the sum of £308 (being £375 less £67). 1 of 2 Case Number: 2301165 /2018 (V) Reasons were given at the time and written reasons will not be provided unless they are asked for by a written request presented by any party within 14 days of the sending of this written record of the decision.
