The claim is struck out.

REASONS

[1]By a letter dated 30 May 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because it has no reasonable prospect of success (the reason being that if, as it appeared, the claimant has less than two years’ of continuous employment, the Tribunal would have no jurisdiction to hear his complaint of unfair dismissal). The complaint of unfair dismissal is the only complaint made in the claim form that has been accepted by the Tribunal.[2]The claimant’s response dated 1 June 2023 confirms that the claimant has less than two years of continuous employment with the respondent. It is clear, therefore, that the Tribunal has no jurisdiction to hear his complaint of unfair dismissal. The claim is therefore struck out.
