JUDGMENT

[1]The breach of contract claim in respect of the failure to pay seven weeks’ notice pay is well founded and the respondent is ordered to pay to the claimant damages in the net sum of £3,094.00.[2]The claimant was unfairly dismissed.[3]The respondent is ordered to pay to the claimant a basic award in the sum of £5,512.50.[4]The respondent having proven on the balance of probabilities that the claimant would have been fairly dismissed had a fair procedure been applied there is no order in respect of a compensatory award.[5]The claim in respect of the respondent’s the failure to provide the claimant with the statutory written terms and conditions of employment is well founded and the respondent is ordered to pay compensation to the claimant equivalent to four weeks’ pay: £2,100.00.
