The Judgment of the Employment Tribunal is as follows:[1]The complaint of race discrimination is dismissed on withdrawal;[2]The Tribunal has no jurisdiction to hear the complaint of unfair dismissal, the Claimant having less than 2 years employment with the Respondent as required by section 108 of the Employment Rights Act 1996;[3]The Tribunal has no jurisdiction to hear the complaints of unauthorised deduction from wages and damages for breach of contract, those complaints having been presented outside the relevant time limits within section 23 of the Employment Rights Act 1996 and article 7 of the Employment Tribunal’s Extension of Jurisdiction (England & Wales) Order 1994.
