JUDGMENT

The Claimant’s application dated 10 December 2019 for reconsideration of the Reserved Judgment, sent to the parties on 26 November 2019 is refused.

REASONS

[1]Having considered the Claimant’s application of 10 December 2019 I have concluded that there is no arguable basis for a reconsideration of the Tribunal’s decision.[2]The contents of the application are an attempt to re-argue matters which have already been considered by the tribunal and rejected. In reaching its decision on all of the disputed issues, the Tribunal took into account the totality of the evidence and the submissions made by the parties., and its conclusions are set out in the detailed judgment and reasons.[3]On the question of the effect of section 18(7) EqA, this is academic as it is unlikely that the Claimant’s case on “refusal to show her the sales figures” would have succeeded as a direct sex discrimination complaint, in any event. From the totality of the evidence, it is unlikely that the Tribunal would have found facts that supported a finding that the Claimant would have been shown the sales figures if she were male.[4]The application for reconsideration is therefore refused.
