The claim is dismissed under Schedule 1, Rule 38 of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013.REASONS
[1]Notice of a Preliminary Hearing to take place on 6 September 2022 was sent to the parties on 6 December 2021. A further notice was sent on 1 September 2022 and details of how to log in were sent on 5 September 2022.[2]Neither the Claimant nor the Respondent attended the Preliminary Hearing nor did they contact to the Tribunal to explain why they would not be attending. The Tribunal tried to contact both of them but there was no response.[3]The Tribunal made an Unless Order on 6 September 2022 - that unless the parties write to the Tribunal saying why they did not attend and why the claim/response should continue, the claim/response would be struck out.[4]No communication from the parties having been received, the claims are therefore dismissed.[5]The hearing listed for 11 and 12 May 2023 is cancelled.
