JUDGMENT

The Respondent having failed to provide a Response to the claims by the due date, it is the decision of the tribunal that:[1]The Respondent has made unlawful deductions from the wages of the Claimant and she is awarded the sum of £1491.00.[2]The claim for breach of contract in respect of failure to pay notice pay succeeds and the Claimant is awarded £486.00[3]The Claimant is awarded two week’s pay capped at £508 per week in accordance with section 38 of the Employment Act 2002 for failure to provide written particulars of employment.[4]The total amount awarded is £3013.00.[5]The Claim for unfair dismissal does not succeed as the Claimant did not have two year’s continuous service.[6]The hearing fixed for 2 July 2018 is adjourned.
