JUDGMENT
The complaint of unlawful deductions from wages is struck out. The hearing listed for 27 September 2022 is vacated.REASONS
[1]The claimant complains that he was not paid his wages from 4 October to 11 October 2021.[2]The respondent has entered a creditors voluntary liquidation.[3]The liquidator has confirmed that the claimant has been paid a sum of £659.38 representing arrears of wages through the redundancy payments service (‘RPS’ an agency that for these purposes represents the second respondent).[4]By letter dated 6 July 2022 the tribunal wrote to the claimant to ask him if he accepted that he had been paid and if so whether he withdrew his claim. No reply has been received.[5]It appears that the claimant has ceased from actively pursuing this matter, no doubt on the basis that he has now received a payment from the RPS.[6]In the absence of any indication from the claimant that other sums are due to him and that he wishes to proceed with the claim, the complaint of unlawful deductions from wages is struck out. The hearing listed for 27 September 2022 has been cancelled.
