JUDGMENT
[1]The claims by Mr Muhammad, the second claimant in claim number 2301008/2022 and the sole claimant in claim number 2301009/2022 are struck out.[2]The claim by the first claimant in claim number 2301008/2022 having been dismissed, these proceedings are concluded.REASONS
[1]The claim form in claim form 2301008/2022 was submitted on 17 March 2022. It set out a claim by the first claimant, Dr Khan, and stated that there was a second claimant. However, no details of any claim by Mr Mohammed were provided and it is unclear whether he was aware that the claim was being advanced in his name.[2]The basic prescribed information relating to the claim was never submitted on the claim form and no early conciliation certificate number was provided. Accordingly no valid claim was presented.[3]No correspondence has been received from Mr Muhammad throughout these proceedings.[4]On 23 May 2022 Dr Khan withdrew her claim without making any mention of Dr Mohammed and the Tribunal has subsequently dismissed her claim on withdrawal.[5]On 7 October 2022 the Tribunal sent an e-mail to Mr Muhammad asking whether he intended to pursue his claim. An e-mail was received in response from Dr Khan stating that Mr Mohammed was deceased. Page 1 of 2 Case Number 2301008/2022 & 2301009/2022[6]It is possible for the personal representatives of an individual claimant to pursue a claim on his or her behalf but no correspondence has been received on behalf of Mr Muhammad at any point.[7]Accordingly, both claims by Mr Mohammed are struck out on the basis:(a) given the lack of any particulars, they have no reasonable prospects of success; and(b) that they have not been actively pursued.
