JUDGMENT

[1]The Claimant’s claim for unfair dismissal is dismissed for lack of jurisdiction under s.108 ERA 1996. JUDGMENT[2]The claim for failure to make a reasonable adjustment under section 21 of the Equality Act 2010 is struck out.

REASONS

[1]At a preliminary hearing held on 25 July 2023 the claimant was ordered to pay a total deposit of £150 or £50 per claim no later than 28 days from the date the Order was sent to the parties. The Order was sent to the claimant on 8 August 2023. By this date the claimant had paid only £100, therefore she had not paid the deposit for one of her claims. The claimant confirmed at a preliminary hearing held on 30 April 2024 that the claim that she did not pay a deposit for was the one for a failure to make reasonable adjustments. This claim is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]Since the deposit was paid for the claims of discrimination arising from disability under section 15 of the Equality Act 2010 and indirect discrimination on the grounds of religion or belief under section 19 of the Equality Act 2010, these remain listed to be determined at a final hearing.
