Employment Tribunals Rules of Procedure 2013 – Rule 21 In the absence of an ET3 response from the Respondent and there being sufficient material before me to enable a proper determination to be made:[1]The claims of disability discrimination and unlawful deductions from wages/breach of contract succeed.[2]The Claimant is awarded £565.00 in respect of unpaid SSP and £85.43 in respect of pension contributions. By way of comensation for the the financial loss sustained by the Claimant, the Claimant is also awarded £253.53 in respect of overdraft charges incurred by the Claimant as a result of the unlawful deductions (s24(2) ERA 1996).[3]A remedy hearing will take place at 2.00pm on 7 December 2020 to determine remedy in respect of the Claimant’s disability discrimination claim.
