JUDGMENT
[1]Under section 163 Employment Rights Act 1996 it is determined that the claimant is entitled to a redundancy payment of £4320.[2]The complaint of breach of contract in relation to notice pay is well-founded and the respondent must pay to the claimant the net sum of £1734.[3]The complaint of unauthorised deductions from wages is well-founded. The respondent made an unauthorised deduction from the claimant's wages in the period from 30 August 2024 to 19 May 2025. The respondent shall pay the claimant £5408.43, which is the net sum deducted. Mr P Russell[4]Mr Russell does not pursue a claim for redundancy payment, having received such from the Redundancy Payments Service (“RPS”).[5]Mr Russell does not pursue a claim for holiday pay, having received such from the RPS.[6]The complaint of unauthorised deductions from wages is well-founded. The respondent made an unauthorised deduction from the claimant's wages in the period from 20 September 2024 to 19 May 2025. The respondent shall pay the claimant £15,517.68, which is the net sum deducted (the sum deducted was £19,810 less the sum of £4292.32 which was a net sum paid by the RPS in respect of unpaid wages). The respondent made an unauthorised deduction from the claimant's wages in the period from 20 September 2024 to 19 May 2025. The respondent shall pay the claimant £8864.67, which is the net sum deducted.[10]The complaint in respect of holiday pay is well-founded. The respondent made an unauthorised deduction from the claimant's wages by failing to pay the claimant for holidays accrued but not taken on the date the claimant’s employment ended.
