The proceedings are dismissed following a withdrawal of the claim by the Claimant. Employment Judge Martin Date: 11 December 2017 THE EMPLOYMENT TRIBUNAL SITTING AT: ASHFORD BEFORE: EMPLOYMENT JUDGE CORRIGAN BETWEEN: Mr R Cherian Claimant AND Well Rose Limited T/a Donnington Manor Hotel Respondent PRELIMINARY HEARING Appearances For Claimant: Mr P Lockley, Counsel For Respondent: Mr B Large, Counsel JUDGMENT[1]The Claimants complaints of unfair dismissal and failure to provide written particulars of employment are dismissed upon withdrawal.[2]The Claimant’s contract claims are withdrawn but not dismissed in accordance with rule 52(a), the Claimant having expressed his wish to reserve the right to bring these claims in the civil courts and the tribunal being satisfied there would be legitimate reason for doing so.[3]It is just and equitable to extend the time limit for submitting the Claimant’s claims for age discrimination and harassment (dated on or after 14 November 2017) to 28 March 2017.[4]The Claimant’s claims from 14th November 2017 onwards are therefore in time and the tribunal has jurisdiction to hear them.[5]The Respondent’s application for costs is refused.
