The respondent having failed to enter a response to this claim, and having heard from the claimant, Judgment for the claimant is entered as follows:[1]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £1,094.40.[2]When the proceedings were begun the respondent was in breach of its duty under s.1 of the Employment Rights Act 1996 to give a written statement of initial employment particulars. The award to the claimant is increased pursuant to s.38 of the Employment Act 2002 by four weeks’ pay, £547.20.[3]The respondent must pay the claimant the total amount of £1,641.60.
