EMPLOYMENT TRIBUNALS
Case No 2300848/2018
Mr G BedwellClaimant(1) CNH2016 Limited (2) Secretary of State for Business Energy & Industrial StrategyRespondent
Employment Judge RamsdenDate 10 July 2024

JUDGMENT

The complaint for a protective award under section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 is struck out.

REASONS

[1]By a letter dated 12 June 2024 the Tribunal gave the Claimant an opportunity to make representations or to request a hearing, as to why the complaint for a protective award under section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 should not be struck out because it:  it has no reasonable prospect of success.[2]The Claimant failed to make any sufficient representations, why this should not be done. The complaint for a protective award under section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 is therefore struck out.[3]The Claimant’s remaining complaints for a redundancy payment, notice pay and arrears of pay are not affected by the terms of this judgment.
