K Saibi v Casual Dining Services Ltd (dissolved): 2300791/2020
JUDGMENT
All claims are struck outREASONS
[1]The respondent company was dissolved on 23 January 2024 and the Claimant has not applied to have it restored to the Register of Companies.[2]On 18 December 2023 the Tribunal wrote to the Claimant to inform them that there was, at that stage, an active proposal at Companies House to dissolve the respondent company. That letter, on the instructions of EJ Fowell, advised the Claimant that if they wished to pursue their claim they would need to show cause (persuade) the Registrar of Companies as to why the respondent company should not be struck off the register. As the claimant has not done so, the Respondent no longer exists and so a claim cannot properly be maintained.[3]In an email from the claimant, dated 30 January 2024, he provides a good deal of narrative information about his claims and his grievance with his former employer. However, none of that information assists him where the respondent company no longer exists.[4]For those reasons, I am satisfied that the claimant has not actively pursued his claims in a manner which would allow them to continue.
