Ms S Howard v A Bertelsmann: 2300728/2023 Ms S Howard v A Bertelsmann: 2300728/2023
JUDGMENT
The complaint of Unfair Dismissal is struck out.REASONS
[1]By a letter dated 13 March 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of Unfair Dismissal should not be struck out because• The claimant lacked the requisite service under section 108 of the Employment Rights Act 1996 nor had provided for any exceptional scenarios which allow for an exception to the requisite two years-service rule.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of Unfair Dismissal is therefore struck out.[3]The claimant’s remaining claim(s) continue and the Tribunal will provide notice of hearing in due course.[4]Employment Judge Nash 28 March 2023 Case No: 2300728/2023 10.2 Judgment - rule 61 February 2018 EMPLOYMENT TRIBUNALS Claimant: Ms Sherine Howard Respondent: Arvato Bertelsmann Heard at: London South Employment Tribunal (by CVP) On: 31 October 2023 Before: Employment Judge Yardley Representation Claimant: In person Respondent: Mr Grahame Anderson – Counsel for of the Respondent
