The claim is struck out pursuant to Rule 37(1)(d) of the Employment Tribunal Rules of Procedure 2013 as it has not been actively pursued.REASONS
[1]By an application dated 21 September 2020, the respondent asked for the claim to be struck out on grounds of non-compliance with orders and/or that the claim had not been actively pursued.[2]On 14 October 2020, the Tribunal wrote to the claimant informing him that Employment Judge Martin was considering striking out his claim because it had not been actively pursued and asked him to write in with any objections to the proposal by 21 October 2020.[3]The claimant did not write in with any objections to the proposals by the due date or at all.[4]In the circumstances, the Tribunal is satisfied that the complaint has not been actively pursued.
