JUDGMENT

[1]The Claimant’s complaint that the Respondent failed to pay a payment in lieu of accrued leave is well-founded and the Respondent is ordered to pay £201.06 to the Claimant, subject to tax and National Insurance.[2]This sum is based on the Claimant’s average weekly pay over the final 12 weeks’ worked (£146.16) and an accrued holiday entitlement of 3.7 weeks (the proportion of the leave year which expired by the termination date was 0.66, and the full statutory leave entitlement is 5.6 weeks).
