JUDGMENT
[1]The first respondent has failed to comply with its duty to consult with the claimants under section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992.[2]The claimants named below are each awarded a protective award of ninety days’ pay.[3]The Employment Protection (Recoupment of Benefits) Regulations 1996 apply.[4]The protected period is 12 October 2022 to 9 January 2023.
