JUDGMENT

[1]The Claimant’s claim of unfair dismissal is dismissed upon withdrawal.[2]The Claimant’s claim of race discrimination is dismissed upon withdrawal.

REASONS

[1]The Claimant has insufficient qualifying service to bring an unfair dismissal claim. He withdrew his claim at the preliminary hearing.[2]The Claimant complains that he was treated badly by the Respondent but was unable to say that the treatment was because of his race (the Claimant is Armenian) and he decided to withdraw his claim at the preliminary hearing.[3]The Claimant confirmed that, despite ticking box 10.1 of his ET1 Claim Form, he is not making a public interest disclosure under the Employment Rights Act 1996.[4]The Claimant’s claim for unauthorised deductions from wages will proceed. _____________________________ Employment Judge Pritchard Date_10 May 2018 Case No: 2300534/2018 10.2 Judgment - rule 61 March 2017 EMPLOYMENT TRIBUNALS Claimant: Mr O Simon Respondent: Rochester Health Club Limited Heard at: London South (Ashford) On: 1 August 2018 Before: Employment Judge John Crosfill Representation Claimant: In person Respondent: Mr T Moore[1]It is declared that the Respondent made an unlawful deduction from the Claimant’s final instalment of wages of £135.[2]The Respondent is ordered to pay the Claimant the sum of £135 as wages.
