JUDGMENT

The claim is struck out.

REASONS

[1]The Tribunal wrote to the claimant on 24 March 2026 warning them that the Tribunal was considering striking out the claim. This was because it appeared to the Tribunal that the claimant had not been employed for two years at the time of presenting the claim of unfair dismissal. The claimant was invited to explain why the claim should not be struck out.[2]The claimant wrote to the tribunal by means of a response form on 2 April 2026 asserting that the qualifying period that applies in a case involving TUPE applies is one year and that on this basis the claim ought to be accepted and not struck out.[3]The claimant is not correct in that assertion. A two-year qualifying period applies in this case and the Tribunal does not therefore have jurisdiction to consider the claimant’s claim of unfair dismissal.[4]The claimant has not made any other claims.[5]Accordingly, the claim is struck out in its entirety.[6]The hearing on 18 and 19 May 2027 will not take place.
