JUDGMENT

[1]By consent the Respondent is ordered to pay to the Claimant the sum of £863.17 in respect of arrears of wages. In addition, the Respondent is ordered to pay the Claimant the sum of £448.00 in respect of unpaid holiday pay.

REASONS

[1]As indicated in the Judgment the Respondents already accept that Ms Bednarz is owed arrears of wages in the sum of £863.17. There is, however, a dispute about the sum claimed in respect of holiday pay Case Number: 2300503/2019 namely a claim of £640.00. The statutory calculation is quite straight forward. Ms Bednarz worked precisely six months of the year. She is therefore entitled to half of the annual statutory allowance of twenty-eight days. Ms Bednarz’s evidence, which I accept, was that she took six days leave but in addition there was one Bank Holiday in that period. Therefore, from the entitlement of fourteen days, is to be deducted seven days. She is therefore entitled to seven days holiday pay and the agreed daily rate is £64.00 so 7 x £64.00 equals £448.00. I therefore award that sum in respect of holiday pay.
