Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The complaints of unauthorised deduction from wages, failure to pay holiday pay and breach of contract succeed.[2]The respondents are ordered to pay the claimant the net sum of £2931.07. 2. The hearing listed on 24 June 2019 is cancelled.REASONS
[1]By a claim form presented on 1 February 2019 the claimant brought complaints against the respondents of unauthorised deduction from wages, failure to pay holiday pay and breach of contract. He claimed that he was employed by the respondents as a gardener until 30 November 2018 and that he was owed unpaid wages, holiday pay and unpaid expenses. He also claimed for bank charges he had incurred as a result of not receiving his wages.[2]The Tribunal notified the respondents of the claim by letter dated 16 March 2019. The deadline for responding was 15 April 2019. The respondents did not submit any response.[3]Pursuant to Rule 21, I have considered whether a determination can properly be made on the available material. I am satisfied that the above determination can be made on the basis of the information and figures given in the claim form. 4.17 Rule 21 judgment – universal template.
