The claim is struck out.REASONS
[1]The claimant submitted this claim on 28 January 2021. He provided a postal address in Chiswick and an email address which appeared to belong to a Ms Trigg. He indicated that he preferred contact by email.[2]His claim was served on the respondent on 22 February 2021.[3]On 1 March 2021 Ms Trigg emailed the Tribunal from the email address supplied in the claim form. She requested that the claim be cancelled.[4]The Tribunal replied on 5 March 2021 asking Ms Trigg to resubmit the email copying in the respondent. That was not done.[5]On 17 March 2021 the Tribunal received another email from the email address given in the claim form but with no specific name given as the sender. That email said, ‘I would like to continue with the claim please’.[6]The respondent then requested that the claim be reserved on its correct address which was done on 8 June 2021.[7]A response was submitted on 30 June 2021 and a copy was sent by the Tribunal to the claimant at the email address on record on 5 July 2021.[8]Later on 5 July 2021 Ms Trigg emailed the Tribunal saying that she is the expartner of the claimant, that he was in Romania and she had asked to cancel the claim. She said that she did not want to receive any more emails regarding the claim as she had nothing to do with it. Case Number: 2300381/2021[9]The Tribunal wrote to Ms Trigg on 19 July 2021 on the instruction of Employment Judge Abbott asking for a forwarding address (postal and email) for the claimant so that any further correspondence could be directed to him as the Tribunal would require the claimant himself to confirm he wishes to withdraw the claim.[10]No reply to that email has been received from either the claimant or Ms Trigg.[11]In all the circumstances it appears that the Tribunal is unable to contact the claimant. The claimant himself has not sought to contact the Tribunal since, at the latest, 17 March 2021.[12]In all the circumstances it appears that the claim is not being actively pursued and is therefore struck out.[13]The Tribunal has no choice but to send this judgement to the address given in the claim form. If Ms Trigg is in a position to forward it to the claimant her cooperation would be appreciated.
