Employment Judge Ferguson Date: 8 September 2021 Case No: 2300329/2021 EMPLOYMENT TRIBUNALS Claimant: Mr M Tomlinson-Allen Respondent: BSP (Knockholt) Ltd Heard at: London South Employment Tribunal On: 14 June 2022 Before: Tribunal Judge Milivojevic acting as an Employment Judge Representation Claimant: In person Respondent: Did not attend REMEDY JUDGMENT It is the Judgment of the Tribunal that:[1]The Respondent shall pay forthwith to the Claimant the sum of £797.50 gross, as a payment for accrued but untaken annual leave at the date of the termination of the Claimant’s employment.[2]The Respondent shall pay forthwith to the Claimant the sum of £1,750 net, as compensation for the statutory notice pay which was due to the Claimant.[3]Subject to 4 and 5 below the Respondent shall pay forthwith the following to the Claimant as compensation for unfair dismissal: a) a basic award of £2,421; and b) a sum for loss of statutory employment rights of £500; and c) a compensatory award of £5,800.[4]The Employment Protection (Recoupment of Benefits) Regulations 1996 apply t o this award.(a) the total award is £8,721(b) the “Prescribed Element” is £5,800(c) the “Prescribed Period” is 28/11/2020 to 14/06/2021(d) the amount by which the monetary award exceeds the Prescribed Element is £2,921.00 Case No: 2300329/2021[5]Payment of the prescribed element in the sum of £5,800 shall be stayed until the Secretary of State has served on the Respondent a recoupment notice in respect of Income Support received by the Claimant or has notified the Respondent that it does not intend to serve such notice.
