[1]By a letter dated 8 March 2019, the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair dismissal should not be struck out, having regard to the terms of Section 108 of the Employment Rights Act 1996. The Claimant not having provided any representations which would bring him within the Tribunal’s powers to determine such an unfair dismissal complaint under the Employment Rights Act 1996, or to request a hearing, the Tribunal struck out that claim.[2]The claimant’s remaining complaint of disability discrimination in relation to his dismissal remains listed for hearing on 22 January 2020 for an Open Case Number: 2300313/2019 Preliminary Hearing, and on 11 August 2020 for a final hearing, if necessary.
