JUDGMENT
[1]Jurisdiction(1) The Tribunal has jurisdiction to hear the claimant’s complaint of unfair dismissal.(2) The claimant provided an ACAS certificate today whereby the EC notification date was 17 January 2019. The EDT was agreed by the parties to be 19 October 2018. The ET1 was presented on 24 January 2019.(3) The previous EC notification relied upon was dated 21 January i.e. outside of the primary limitation period.(4) The EC notification of 17 January 2019 had an error related to the respondent’s identity which was the omission of ‘UK’.(5) The Tribunal exercising its discretion under Rule 12 (2A) of the Employment Tribunals Regulations 2013 considered this to be a minor error. 1.1[3]The claim is dismissed upon withdrawal by the claimant.
