JUDGMENT

[1]The name of the Respondent is amended to Glasshouse (BexleyHeath) Limited.[2]The Claim for unpaid holiday pay was not brought within the relevant statutory time limit when it was reasonably practicable for that Claim to have been brought within that time limit. Accordingly the tribunal does not have jurisdiction to consider that claim and that Claim is dismissed.[3]The Claimant was an employee of the Respondent pursuant to Section 230 (1) of the Employment Rights Act 1996 (ERA).[4]It is declared that the Claimant was dismissed by reason of redundancy as defined by section 139 (1)(a)(i) and /or (ii) ERA and shall be paid £787.50 as a redundancy payment.[5]Further upon the Tribunal making an award against the Respondent and upon it being satisfied that when the proceedings were begun the Respondent was in breach of its obligations to provide a written statement of particulars of the Tribunal awards two weeks’ pay in relation thereto in the sum of £350.[6]The total sum payable pursuant to this Order is £1,137.50.
