REASONS

[1]By a claim form presented on 22 January 2019, the Claimant complained of unfair dismissal, breach of contract and unlawful deduction of wages. The claims were resisted by the Respondent.[2]By a letter dated 18 February 2019, the parties were notified that the matter had been listed for 1 day on 22 May 2019. The notice included various standard case management orders and a timetable for compliance. These included a requirement to exchange documents and written statements of evidence.[3]On 11 April 2019, the Respondent made an application for the claim to be struck out on grounds that the Claimant had failed to comply with the case management orders and had failed to actively pursue his case.[4]On 1 May 2019, the Tribunal wrote to the Claimant, on the instructions of Employment Judge Andrews, asking him to confirm by 4pm on 3 May 2019, whether he wished to pursue his claim and whether he had complied with the case management orders. There was no response.[5]On 3 May 2019, the Respondent renewed its application for strike out of the claim, having received no contact from the Claimant.[6]The hearing remained in the list for the 22 May 2019, but the Claimant failed to attend or notify the Tribunal of his non-attendance in advance.[7]In those circumstances, the claim has been struck out pursuant to rules 37(1)(c ) and 37(1)(d) of the Employment Tribunal Procedural Rules 2013.
