The claim is struck out.REASONS
[1]This matter was listed for a final hearing at 2pm on 8 September 2022.[2]Orders were sent to the parties on 3 February 2022 setting out a timetable for preparation for that hearing.[3]On 28 July 2022 the tribunal wrote to the parties asking them to confirm by 11 August 2022 if they had complied with any relevant orders and would be ready to proceed with the hearing. They were advised that if they did not inform the tribunal regarding their readiness for hearing on or before that date an Employment Judge may consider striking out the claim or response on the ground that it is not being actively pursued.[4]The claimant has not replied to that letter and the respondent has notified the tribunal that he has not complied with any of those orders.[5]Accordingly it is apparent that the claimant is not actively pursuing his claim and it is struck out. The hearing on 8 September 2022 is vacated.
