JUDGMENT

[1]The claim for unpaid pages is upheld. The Claimant is awarded £39,762.69 gross pay in respect on unpaid salary between 28th April 2019 and 1st November 2019.

[2]The claim for holiday pay is dismissed. In so far as it relates to holiday taken during employment that was not paid, it is subsumed by the wages claim above. In so far as it relates to a payment on termination related to holiday there is insufficient information about the holidays the Claimant had taken to uphold the claim.

[3]The claim for breach of contract is upheld and the Claimant is awarded £25,000 in respect of these claims. This relates to unpaid pension contributions during employment amounting to £6,250 and wrongful dismissal / pay in lieu of notice amounting to six months gross salary / £62,500.

[4]Note that the Employment Tribunal’s jurisdiction in breach of contract claims is limited by the Employment Tribunals Act 1996 and the Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994. In particular, the Employment Tribunal may not order a payment of an amount exceeding £25,000 in relation to the same contract (see para 10 of the Extension of Jurisdiction Order).
