JUDGMENT
[1]The claimant’s claim for unlawful deduction of wages succeeds and the respondent must pay him £1000 gross.[2]The claimant’s claim for failure to pay notice pay succeeds and the respondent must pay him £500 gross[3]The total that the respondent must by the claimant is £1500 gross.REASONS
[1]The claimant was employed by the respondent as a chef, from 1 October 2020 until 1 September 2022. Early conciliation started on 9 November 2022 and ended on 5 December 2022. The claim form was presented on 5 January 2023 and he therefore presented a valid claim in time.[2]He presented a clear case, which he confirmed to the Tribunal today at this hearing, that the responded failed to pay him his last two weeks of pay and one week of notice pay that he was entitled to under his contract. He has said his weekly pay was £500. 10.7 Judgment with reasons – rule 62 March 2017 Case No: 2300073/2023[3]The respondent has failed at any time to respond the claim despite bring sent notice of the claim and notice of this hearing from the Tribunal. The Tribunal clerk telephoned the respondent twice today but received no answer. It appears to the Tribunal that the respondent has chosen not to engage with the claim.[4]The Tribunal is satisfied that a determination can properly be made of the claim in accordance with rule 21 of the Rules of Procedure.[5]The respondent must be the claimant the sum indicated above.[6]The Tribunal informed the claimant that he is responsible for any figures owed to HMRC for tax or national insurance.
