Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The Respondent has not responded to the Claimant’s claim and has failed to pay the Claimant:a. Wages amounting to the sum of £3,549.26 (6.5 weeks’ net pay at an annual salary of £40,000);b. Notice pay amounting to the sum of £546.04 (one week’s net pay)c. Holiday pay in respect of 3.5 days’ holiday outstanding on termination of employment in breach of Regulation 14(2) Working Time Regulations 1998 and amounting to the net sum of £382.23.[2]The total amount due from the Respondent to the Claimant is therefore £4,477.53, payable forthwith.[3]The Claimant does not have the necessary qualifying service to bring a claim of unfair dismissal and his unfair dismissal claim is dismissed. .
