JUDGMENT

[1]The Respondent failed in its duty to consult appropriate employee representatives on redundancy pursuant to section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992 (TULRCA). The number of employees dismissed exceeded 20 and the dismissals occurred without any collective consultation on redundancy.[2]The Claimant’s claim for a protective award is well founded.[3]THE PROTECTED PERIOD STARTED ON 20 DECEMBER 2019. The Tribunal awards 90 days’ pay in respect of the Claimant pursuant to Section 189 TULRCA.
