JUDGMENT

UPON reading the joint application submitted by or on behalf of;[1]The represented claimants named in Schedules 1-4 (“the Claimants”);[2]ISG Central Services Limited (in Administration);[3]ISG Construction Limited (In Administration);[4]ISG Interior Services Group UK Limited (In Administration); and[5]ISG Retail Limited (in Administration); AND UPON those parties and the unrepresented claimants having agreed to the terms of the Judgment set out below by consent, the Judgment of the Employment Tribunal made pursuant to Rule 62 The Employment Tribunal Procedure Rules 2024 is that: Claims against ISG Central Services Limited (in Administration) The protective award claims under section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992[6]In relation to the Claimants named in Schedule 1, all of whom were dismissed on or within 90 days of 20.09.24, to this Judgment only;6.1 ISG Central Services Limited (in Administration) failed to comply with section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992 and their claim for a protective award brought under section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992 succeeds.6.2 ISG Central Services Limited (in Administration) is ordered to pay remuneration (i.e. a protective award) to the Claimants named in Schedule 1 for a protected period of 90 days beginning on 20.09.2024 (being the date on which the first of the dismissals to which the complaint relates took effect) to those Claimants.6.3 In determining the above the tribunal considered the issues set out in the response from the fifth respondent, namely establishment, representatives and whether there was any consultation and resolved these issues in favour of the claimants.[7]Claims against ISG Construction Limited (In Administration) The protective award claims under section 189 of the Trade Union & Labour Relations (Consolidation) Act 19927.1 In relation to the Claimants named in Schedule 2, all of whom were dismissed on or within 90 days of 20.09.24, to this Judgment only;7.2 ISG Construction Limited (In Administration) failed to comply with section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992 and their claim for a protective award brought under section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992 succeeds.7.3 ISG Construction Limited (In Administration) is ordered to pay remuneration (i.e. a protective award) to the Claimants named in Schedule 2 for a protected period of 90 days beginning on 20.09.2024 (being the date on which the first of the dismissals to which the complaint relates took effect) to those Claimants.[8]Claims against ISG Interior Services Group UK Limited (In Administration) The protective award claims under section 189 of the Trade Union & Labour Relations (Consolidation) Act 19928.1 In relation to the Claimants named in Schedule 3, all of whom were dismissed on or within 90 days of 20.09.24, to this Judgment only;8.2 ISG Interior Services Group UK Limited (In Administration) failed to comply with section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992 and their claim for a protective award brought under section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992 succeeds.8.3 ISG Interior Services Group UK Limited (In Administration) is ordered to pay remuneration (i.e. a protective award) to the Claimants named in Schedule 3 for a protected period of 90 days beginning on 20.09.2024 (being the date on which the first of the dismissals to which the complaint relates took effect) to those Claimants.[9]Claims against ISG Retail Limited (in Administration) The protective award claims under section 189 of the Trade Union & Labour Relations (Consolidation) Act 19929.1 In relation to the Claimants named in Schedule 4, all of whom were dismissed on or within 90 days of 20.09.24, to this Judgment only;9.2 ISG Retail Limited (in Administration) failed to comply with section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992 and their claim for a protective award brought under section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992 succeeds.9.3 ISG Retail Limited (in Administration) is ordered to pay remuneration (i.e. a protective award) to the Claimants named in Schedule 4 for a protected period of 90 days beginning on 20.09.2024 (being the date on which the first of the dismissals to which the complaint relates took effect) to those Claimants. Costs[10]There is no order requiring any of the Claimants or any of the Respondents to pay or reimburse any other party’s costs or fees in relation to the claims referred to in Schedules 1-4 and each party shall bear their own costs and fees in relation to those claims. Administration[11]Subject to the normal categories of preferential debts set out in Schedule 5 of the Insolvency Act 1986, any payments made by the Companies (rather than the Secretary of State) pursuant to this Judgment will be paid as an unsecured dividend. Recoupment[12]The Employment Protection (Recoupment of Jobseeker’s Allowance and Income Support) Regulations 1996 apply to this award as set out at Schedule 5. Remaining Claims[13]All remaining claims, including those for unfair dismissal, constructive dismissal, arrears of pay, holiday pay, redundancy pay and notice pay, are dismissed upon withdrawal.
