On hearing the claim filed by the Claimant on 30 January 2019 the decision of the tribunal is that:-[1]It is declared that the Claimant was employed by Brett Newmark.[2]Brett Newmark shall immediately pay to Miss D Barahona Guerra the following amounts:-(a) Unpaid wages for the period 23 October 2018 to 16 November 2018 £1,440(b) Compensation under section 38 of Employment Act 2002 for failure to provide a statement of employment particulars £800 Total: £2,240[3]The amounts in (a) and (b) are calculated gross and may be subject to deductions on payment. Note: Reasons for the decision having been given orally at the hearing, written reasons will not be provided unless a written request is received from either party within 14 days of the sending of this record of the decision.
