The application to strike out the claim is refused. The Tribunal will decide at the final hearing whether or not the claim was presented within the applicable time limit and, if not, whether it is just and equitable to extend the time limit for bringing the claim. The application for a deposit order to be made against the claimant is refused. It cannot be said that the claimant stands little reasonable prospects of arguing that his claim was presented within the applicable time limit, or that it is just and equitable to extend the time limit for bringing the claim, or that his claims of race discrimination and breach of contract stand little reasonable prosects of success.
